The petitioners – David Kilundu, Robson Abonyo Akoth and Joseph Irungu Kimemia – are challenging the validity of the results, which saw Charles Nyaberi elected president, with national women’s volleyball team assistant coach Paul Bitok as his deputy.
In a letter signed and issued by SDT deputy chairperson Elynah Sifuna-Shiveka, the case is set for mention on Tuesday next week, a hearing that will be conducted online via Microsoft Teams.
“Upon perusal of the petition under certificate of urgency and notice of motion, and
all other documents as filed by Jausiku & Company advocates dated 21st August, 2023, the Tribunal hereby directs, and orders that the matter be certified as urgent,” the Tribunal said.
Despite the petitioners’ prayers, the tribunal declined to issue stay orders and directed them to serve a mention notice.
“The Tribunal declines to issue any stay orders. The Petitioners should undertake to serve a mention notice,” the letter continued.
In their certificate of urgency submitted before SDT, the petitioners argue that two non-delegates who were not eligible to vote were allowed to participate.
Moreover, delegates from five county branches that had not been registered with the Sports Registrar were allowed to cast their votes.
The development comes even as Sports CS Ababu Namwamba on Wednesday urged lawmakers to help clamp down on errant officials of sports federations in the country.
He also spoke of his ministry’s frustration in streamlining governance structures within various federations.
